Immigration and Protection Tribunal

  • A person can appeal the decision of Immigration Minister or the delegated official if their residence class visa:

    • is declineed;

    • is canceled; or

    • their application for a resident visa is denied, or they are refused entry into New Zealand.

    Such decisions can be appealed to the Immigraiton and Ptotection Tribunal.

  • A person can appeal to the Tribunal against a refugee and protection officer's decision to:

    • decline their claim for refugee or protected person status,

    • decline to accept their claim for recognition as a refugee or protected person for consideration,

    • cancel or cease their recognition as a refugee or protected person, or

    • refuse to consider their subsequent claim for refugee or protected person status.

  • A deportation appeal involves appealing against the liability for deportation of:

    • a resident visa holder,

    • a permanent resident, and

    • a person with refugee and/or protection status that has been canceled.

  • A Non-Resident Visa Holder can to appeal to IPT if:

    • they are unlawfully in New Zealand,

    • their temporary or interim visa was granted in error,

    • they held a temporary or interim visa under a false identity,

    • they held a temporary or interim visa, and it was determined that there is sufficient reason for deportation, or

    • they are a refugee and protection claimant appealing against a decision by a refugee and protection officer and would be entitled to a humanitarian appeal if you become liable for deportation.
